Welcome to Isa Amaka. These Terms & Conditions govern your use of our website and the purchase of products from us. By accessing this website or placing an order, you agree to be bound by these Terms & Conditions.

If you do not agree to these Terms & Conditions, please do not use this website.

1. General

This website is operated by Isa Amaka. Throughout the site, the terms “we”, “us” and “our” refer to Isa Amaka.

We reserve the right to update, change or replace any part of these Terms & Conditions at any time by posting updates to our website. It is your responsibility to check this page periodically for changes.

2. Products

We make every effort to display our products, materials, finishes and colours as accurately as possible. However, we cannot guarantee that your device or screen will display colours, textures or finishes exactly as they appear in person.

Many Isa Amaka pieces are handcrafted. As a result, slight variations in finish, texture, tone or detail may occur. These are not considered defects, but part of the nature and character of the piece.

We reserve the right to amend, discontinue or limit any product at any time without notice.

3. Pre-Orders and Made-to-Order Pieces

Isa Amaka currently operates on a pre-order and made-to-order basis for selected products.

Pre-order windows are open for a limited period. Once the pre-order window closes, production begins. Estimated production timelines are provided as guidance only and are not guaranteed.

Where a piece is made to a customer’s specifications, personalised, bespoke, or custom-sized, change-of-mind return or cancellation rights may be more limited than for standard products. However, nothing in these Terms & Conditions excludes, restricts or modifies any rights you may have under the Australian Consumer Law.

4. Orders

All orders are subject to acceptance and availability.

After placing an order, you will receive an order confirmation email. This does not necessarily mean your order has been accepted. We reserve the right to refuse, cancel or limit any order at our discretion, including where there is an issue with pricing, availability, suspected fraud, or an error in product information.

If we cancel an order after payment has been taken, we will refund the amount paid for that order.

5. Pricing and Payment

All prices are listed in [insert currency] and are subject to change without notice.

We take reasonable care to ensure that pricing is correct. However, errors may occur. Where a pricing error is identified, we reserve the right to cancel the order and refund any amount paid.

Payment must be made in full at checkout using the payment methods made available on the website.

6. Shipping and Delivery

Delivery times are estimates only. Production timelines, courier delays, customs processing and other events outside our control may affect delivery dates.

Customers are responsible for providing accurate shipping and contact information at checkout. Isa Amaka is not responsible for delays, failed deliveries or losses resulting from incorrect information supplied by the customer.

Where applicable, customs duties, import taxes and related charges are the responsibility of the customer unless otherwise stated.

7. Change of Mind

Because many Isa Amaka pieces are made to order, bespoke, personalised or custom-sized, we do not accept returns or exchanges for change of mind on these items.

If you wish to contact us about an order before it has entered production, please email returns@isaamaka.com as soon as possible. We will review such requests at our discretion.

Nothing in this section excludes, restricts or modifies any rights you may have under the Australian Consumer Law.

8. Returns, Repairs and Faulty Items

Custom sizes and made-to-order pieces are not eligible for return or exchange for change of mind.

If you believe your item is faulty, damaged, not as described, or otherwise does not meet the consumer guarantees under Australian law, please contact us at returns@isaamaka.com with your order number, photographs, and a description of the issue.

We ask that customers notify us within 15 days of delivery so that we can assess the issue promptly. However, this request does not limit or replace any rights you may have under the Australian Consumer Law. The ACCC has specifically warned businesses against imposing time limits that misstate consumers’ rights for faulty products.

Where a product does not meet a consumer guarantee, the available remedy under Australian law may include a repair, replacement or refund, depending on whether the issue is minor or major. ACCC guidance states that where goods fail consumer guarantees, consumers may be entitled to a repair, replacement, refund or other remedy, and that a business cannot refuse these rights by substituting a store policy.

A store credit may be offered where appropriate and agreed with the customer, but it does not replace any remedy required under the Australian Consumer Law. ACCC guidance also makes clear that consumers are not entitled to a remedy merely because they changed their mind, but they are entitled to remedies where consumer guarantees are breached.

We reserve the right to reject claims where the item shows signs of normal wear and tear, accidental damage, misuse, improper storage, improper care, unauthorised repair or alteration, or damage caused by failure to follow care guidance. ACCC guidance similarly distinguishes consumer-guarantee failures from damage caused by misuse or change of mind.

If a return is approved because the item is faulty or because we made an error, we will cover the reasonable cost of return shipping.

9. Product Care

Jewellery should be handled and stored with care. Exposure to moisture, chemicals, perfumes, lotions, impact, abrasion and improper storage may affect the appearance and longevity of a piece.

Natural wear over time, including surface scratching or tarnishing where applicable, is not considered a manufacturing fault.

Customers are responsible for following any care guidance provided by Isa Amaka.

10. Intellectual Property

All content on this website, including but not limited to product designs, text, copy, imagery, branding, graphics, logos and website content, is the intellectual property of Isa Amaka or its licensors.

No part of this website or its content may be copied, reproduced, republished, distributed, altered or used for commercial purposes without our prior written permission.

11. Website Use

You agree not to misuse this website or use it for any unlawful, fraudulent or harmful purpose.

We reserve the right to suspend, restrict or terminate access to the website where we reasonably believe there has been a breach of these Terms & Conditions or misuse of the site.

12. Limitation of Liability

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified. ACCC guidance states that consumer guarantees apply automatically and cannot be signed away through a store’s terms.

Subject to the above, Isa Amaka shall not be liable for any indirect or consequential loss arising out of the use of this website or the purchase of products from it.

13. Force Majeure

We are not liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, strikes, supply shortages, transport disruption, customs delays, pandemics, cyber incidents or governmental action.

14. Governing Law

These Terms & Conditions are governed by the laws of Western Australia, Australia.

Any disputes arising in connection with these Terms & Conditions will be subject to the non-exclusive jurisdiction of the courts of Western Australia.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law. The ACL applies in WA through the Fair Trading Act 2010 (WA).
